This policy contains the practices and procedures we follow in relation to the collection, processing, and use of your information that you provide to us while using our Website, in accordance with the provisions of the Information Technology Act, 2000 and the rules notified thereunder including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information), Rules 2011 (SPDI Rules), Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and other applicable laws. 

Prior to using or availing any of the services offered on our Website (“Services”), kindly read the privacy policy carefully and if you do not agree to the terms of this policy, please refrain from accessing the Website. This policy is an integral part of the User Agreement and shall be deemed to be incorporated therein by reference. By accessing the Website or using the Website: (i) you agree to be bound by this privacy policy; and (ii) you consent to the use, collection, processing, storage, and sharing of the data in the manner specified herein. 

In this policy, the term ‘Website’ refers to www.lordfincap.com as well as any other related products and services that refer or link to this privacy policy, the terms ‘we’ or ‘our’ or ‘us’ refer to Lord Fincap Limited (“Lord Fincap”), the company owning and managing the Website; and the term ‘you’ or ‘your’ refers to the user who uses our Website or registers on our Website for himself / herself or is validly authorised on behalf of any other person to use and access our Website for benefit of such other person. In the event you are accessing or using this Website on behalf of some other person, we shall assume that you are duly authorised by such person to share their information with us and we shall not independently verify the veracity of your authorisation. In the event you do not have sufficient authorisation to share such information with us, you shall be solely responsible for your acts and omissions including sharing of information with us by you. 

Any part of this privacy policy can be changed without any notice to you. The updated policy shall be posted on the Website so that it is always available to you and we encourage you to periodically go through our privacy policy; however, in case of substantial changes to the policy, we shall notify you in accordance with applicable laws through your email id / phone number provided to us.

What information do we collect?

1. When you use our Website or avail of our Services, information relating to you is collected by us, which includes:

  • a. personal data such as your name, date of birth, address, gender, e-mail address, telephone or mobile number, age, marital status, occupation, income, health and disability data, family information, unique login name, details of occupation, employer, credit score, your credit history, salary slips, bank statements;
  • b. information provided during the KYC process including masked aadhar card, PAN etc.; data provided when you fill up details to avail the loan; 
  • c. Sensitive Personal Data including information relating to government ID cards, driver license, financial information such as bank account or credit card or debit card or other payment instrument details or asset information;
  • d. Any other information provided to us at the time of the creation of your account on our Website, details regarding your social schemes, your work experience, your employment history, service-related preferences, internet protocol address, as well as one-time access for camera, microphone, location, during on boarding/KYC requirements;
  • e. information and files uploaded by you on your profile or when you use the Website information such as how you use the services and your activity on the Website, your signature, user taps and clicks, browser type and version, user interests, time spent on the Website, details about the user journey, job postings, gig works and page views; data provided when you communicate with us;
  • f. Any information relating to marketing and communications, such as your address, email address, information posted in service requests, offers, discounts, letters, wants, feedback, comments, testimonials, endorsements, pictures, and discussions in our blog and chat boxes, discussions on whatsapp chats, community posts, responses to user surveys and polls, your preferences in receiving marketing communications from us and our third parties, customer service calls or audio recordings and your communication preferences, information collected from the lending service providers, communications from us and our last mile delivery partners for employment/gig opportunities and other partner agencies such as i) Karza Technologies Private Limited for KYC verification purposes (including PAN, Aadhaar OCR, Voter ID OCR, Driving License OCR, Name and Address Match, Bank Account Verification); ii) Experian Credit Information Company of India Private Limited for purposes of obtaining the CIBIL score; iii) Cms – Ident Private Limited for purposes of obtaining bank statement; iv) Think Analytics India Private Limited for purposes of SMS Parsing and Bank Statement Analyzing; v) Crime Check Times Private Limited for purposes of checking crime history (FIRs); v) Nupay (Entellus Business Solutions Pvt Ltd.) for purposes of eNACH and Mandate Registration; vi) Signdesk (DeskNine Pvt. Ltd.) for signature of Digital Agreement.
 

2. When you log in to our Website or sign in to your account on our Website using a third party interface (your google account, facebook account etc.), we collect the information as allowed by such third party. For more information on how much data and information is shared by such third parties with us, please refer to their respective privacy policies or their terms on data sharing. 

 

3. We also use ‘cookies’. Cookies are small pieces of data that are stored in your computer and they help us in remembering/recalling some information about you while you access our Website such as your preferences, your log in details etc. You may change the cookie settings on your browser if you are not agreeable to the use of cookies.

 

4. We under no circumstances and at no point take any biometric data from you for any of our services or operations.

For the provision of lending related Services, we shall only store basic personal information such as name, address, contact information,  status of your loan, EMIs etc. which are required to be stored for providing you with the Services. We ensure that lending service providers/digital lending apps engaged by the Company does not store personal information of borrowers except some basic minimal data (viz., name, address, contact details of the customer, etc.) that may be required to carry out their operations. We ensure that every data or information that we collect from you is stored in servers located in India and the same is in compliance with all the statutory/regulatory obligations. 

We shall record your transactions and information related to the transactions as per the Prevention of Money Laundering Act , 2002 and rules therein.

We shall store and preserve your data to the extent mentioned above: (i) no longer than necessary for the purposes for which the personal information is received and processed and shall be destroyed from our servers, thereafter; or (ii) in accordance with applicable laws.

Sharing and Transfer of Data / Intended Recipients

1. We will share your information third parties for purposes mentioned in this policy and in respect of provision of the Services. We shall take your explicit consent sharing personal information with any third party, except for cases where such sharing is required as per statutory or regulatory requirement. 

2. We ensure that any collection of data by the digital lending apps or the digital lending apps of the legal service providers is need-based and with your prior and explicit consent of the having audit trail. We also ensure that the digital lending apps desist from accessing mobile phone resources like file and media, contact list, call logs, telephony functions, etc. Only a one-time access can be taken for camera, microphone, location or any other facility necessary for the purpose of on-boarding/ KYC requirements, with your explicit consent.

3. We shall ensure that we share such data only with entities who provide for atleast equivalent data security measures as that provided by us. 

4. We also share your information with government agencies, judicial forums if we are required by the law or by a judicial order, to do so. 

5. We may also share your information with our affiliate entities and employees, staff members, officials solely in connection with the purposes highlighted above and to fulfil the transactions for which our services have been availed.

Delete your personal data

1. You have the right to delete or request that we assist in deleting the personal data that we have stored about you by sending an email info@uat.priyankpandey.in. In case we have collected any data about you and shared it with third parties as per terms of this policy, please note that we will inform such third party regarding your request for deletion of the data. Please note that any request for deletion of data may impact the provision of our Services to you.

2. Similar process is also to be followed in case you intend to review the data provided to us.

Security of your Data

1. We use robust and stringent security practices in managerial, technical, operational and physical security control measures when it comes to the storage, use, and processing of your data. 

2. We ensure that we and lending service providers engaged by us comply with various technology standards/ requirements on cybersecurity stipulated by Reserve Bank of India and other agencies, or as may be specified from time to time, for undertaking digital lending.

3. We will take reasonable measures to keep your information secure, but we shall not be liable for any loss or unauthorised access or any harm caused to you by any misuse of your personal information, unless it is a direct and foreseeable consequence of negligence and non-compliance on our part only. 

4. You are responsible for maintaining your login credentials and other allied password recovery mechanisms like phone numbers and e-mail accounts secure. 

5. We cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the internet. You accept the inherent security implications of data transmission over the internet and the internet cannot always be guaranteed as completely secure. Therefore, your use of the Website will be at your own risk. If you have any concerns, please feel free to contact us.

6. In case we are made aware of any security breach relating to the data, we shall inform the Reserve Bank of India immediately in accordance with applicable laws.

Acknowledgement

1. If you visit any third party websites or links that may be available on the Website, please note that the use and collection of your data will be governed by such third party’s privacy policy and we shall not be liable in any manner whatsoever for use and processing of such data by third parties.

2. By agreeing to this policy, you also agree to not host, store, transmit, display, upload, modify, update, share or publish, on our Website or any such platform (e-mail groups etc) which you are a part of, by virtue of accessing or using the Website or by virtue of using our Website or by availing our services, any information that

  1. belongs to another person and to which the user does not have any right;
