Privacy Policy

This policy contains the practices and procedures we follow in relation to the collection, processing, and use of your information that you provide to us while using our Platform, in accordance with the provisions of the Information Technology Act, 2000 and the rules notified thereunder including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information), Rules 2011 (SPDI Rules), Reserve Bank of India Guidelines on Digital Lending, 2022, Reserve Bank of India Circular on Loans Sourced by Banks and NBFCs over Digital Lending Platform: Adherence to Fair Practices Code, Directions on Managing Risks and Code of Conduct in Outsourcing of Financial Services by NBFCs dated November 9, 2017 and other applicable laws.

Prior to using this Platform, kindly read the privacy policy carefully and if you do not agree to the terms of this policy, please refrain from accessing the Platform. This policy is an integral part of the User Agreement and shall be deemed to be incorporated therein by reference. By accessing the Platform or using the Platform: (i) you agree to be bound by this privacy policy; and (ii) you consent to the use, collection, processing, storage, and sharing of the data in the manner specified herein.

In this policy, the term ‘Platform’ refers to Lord Fincap Limited and the Rockett App as well as any other related products and services that refer or link to this privacy policy, the terms ‘we’ or ‘our’ or ‘us’ refer to Lord Fincap Limited, having its office at Upper Ground Floor, HS-33, Kailash Colony Market, New Delhi – 110048 (“LFL”), the company owning and managing the Platform; and the term ‘you’ or ‘your’ refers to the user who uses our Platform or registers on our Platform for himself / herself or is validly authorised on behalf of any other person to use and access our Platform for benefit of such other person. In the event you are accessing or using this Platform on behalf of some other person, we shall assume that you are duly authorised by such person to share their information with us and we shall not independently verify the veracity of your authorisation. In the event you do not have sufficient authorisation to share such information with us, you shall be solely responsible for your acts and omissions including sharing of information with us by you.

Any part of this privacy policy can be changed without any notice to you. The updated policy shall be posted on the Platform so that it is always available to you and we encourage you to periodically go through our privacy policy; however, in case of substantial changes to the policy, we shall notify you in accordance with applicable laws through your email id / phone number provided to us.

A. What information do we collect?

1. When you use our Platform or avail of our Services, information relating to you is collected by us, which includes:

personal data such as your name, date of birth, address, gender, e-mail address, telephone or mobile number, age, marital status, details of owned houses, occupation, income, unique login name, details of occupation, years of experience, employer details, driving license, your credit history, salary slips, bank statements;
information provided during the KYC process including masked aadhar card, PAN, address proof, etc.; data provided when you fill up details to avail the loan;
Sensitive Personal Data including financial information such as bank account or credit card or debit card or other payment instrument details;
Any other information provided to us at the time of the creation of your account on our Platform, details regarding your social schemes, your work experience, your employment history, data relating to your vehicle including any instances of road accidents, fines imposed for traffic violation and road safety, service-related preferences, internet protocol address, as well as one-time access for camera, microphone, location, during on boarding/KYC requirements;
Data collected through your explicit consent for SMS parsing of non-personal messages (such as messages relating to loans availed, credit cards etc.) for purposes of credit evaluation;
information and files uploaded by you on your profile or when you use the Platform information such as how you use the services and your activity on the Platform, your signature, user taps and clicks, browser type and version, browser information on use of the Services via the App, user interests, time spent on the Platform, details about the user journey, job postings, and page views; data provided when you communicate with us;
Any information relating to marketing and communications, such as your address, email address, information posted in service requests, offers, discounts, letters, wants, feedback, comments, testimonials, endorsements, pictures, and discussions in our blog and chat boxes, discussions on whatsapp chats, community posts, responses to user surveys and polls, your preferences in receiving marketing communications from us and our third parties, customer service calls or audio recordings and your communication preferences.

2. Information relating to you is also provided to us by our strategic partners listed on the Platform in accordance with their respective privacy policies (such as the OEMs and our partner companies providing you with employment opportunities). This information includes your performance, days of absence, total earnings, total number of trips, whether you have quit employment, details of car booked etc. We also store data relating to the actual loan disbursed to you, details regarding the security / asset provided for such loan disbursement etc. We collect information relating to the electric vehicle booked through our Platform and location tracking of the vehicle.
3. When you log in to our Platform or sign in to your account on our Platform using a third party interface (your google account, facebook account etc.), we collect the information as allowed by such third party. For more information on how much data and information is shared by such third parties with us, please refer to their respective privacy policies or their terms on data sharing.
4. We also use ‘cookies’. Cookies are small pieces of data that are stored in your computer and they help us in remembering/recalling some information about you while you access our Platform such as your preferences, your log in details etc. You may change the cookie settings on your browser if you are not agreeable to the use of cookies.
5. We under no circumstances and at no point take any biometric data from you for any of our services or operations.

B. How do we use the information collected?

1. We shall use the collected data and information for the following purposes-

To verify your identity;
To evaluate your loan application;
To undertake credit evaluation at the time of loan application and on-going credit evaluation and monitoring;
To enforce our rights as lender in case of default on the loan;
To share your data with our partners who may provide you with employment opportunities
To share your data with OEMs / dealers in case you have shown interest in purchasing an electric vehicle through our Platform;
To enable you to avail Services on our Platform and provide you with the relevant Services including displaying information regarding your borrowings, status of loan, EMIs, vehicle related information, driver license etc.;
To share data with third parties for matters relating to credit evaluation, KYC checks, loan disbursement, repayment, loan servicing and such matters ancillary to or relevant for provision of Services;
To perform any rights and obligations that arise out of any agreement between you and us;
To communicate with you regarding your service requests including updates, changes, etc;
To improve user experience and quality of our Services based upon your preferences etc. including improving the quality and content of the Platform;
To help us learn about your service requests and support needs;
To send messages, alerts, and any other promotional information to you regarding our services and related matters including any surveys, feedback forms etc.;
To share information with governmental agencies pursuant to lawful requests for information as required under any law applicable in India and outside India;
To enforce the terms of this policy or to defend ourselves or our employees / agents in legal proceedings;
To share information with our employees, etc. on a need to know basis for purposes of customer support or to resolve your queries /feedback or to enhance the quality of user experience for you;
To review Platform insights and performance without identifying you;
To perform our obligations and to enforce our rights as recovery agents.

C. How long will we be storing your Data?

We shall all store your data: (i) no longer than necessary for the purposes for which the personal information is received and processed; or (ii) in accordance with applicable laws.

D. Sharing and Transfer of Data / Intended Recipients

We will share your information with third parties for purposes mentioned in this policy.
We shall ensure that we share such data only with entities who provide for atleast equivalent data security measures as that provided by us.
We also share your information with government agencies, judicial forums if we are required by the law or by a judicial order, to do so.
We may also share your information with our affiliate entities and employees, staff members, officials solely in connection with the purposes highlighted above and to fulfil the transactions for which our services have been availed.
LFL is the collector of the information and will retain your information as mentioned above, and the address is: Upper Ground Floor, HS-33, Kailash Colony Market, Sector 4, Kailash Colony, Greater Kailash, New Delhi, Delhi 110048.

E. Delete your personal data

You have the right to delete or request that we assist in deleting the personal data that we have stored about you by sending an email to tech@lordfincap.com. In case we have collected any data about you and shared it with third parties as per terms of this policy, please note that we will inform such third party regarding your request for deletion of the data. Please note that any request for deletion of data may impact the provision of our Services to you and such deletion will be undertaken to the extent possible.
Similar process is also to be followed in case you intend to review the data provided to us.

F. Security of your Data

We use robust and stringent security practices in managerial, technical, operational and physical security control measures when it comes to the storage, use, and processing of your data.
We will take reasonable measures to keep your information secure, but we shall not be liable for any loss or unauthorised access or any harm caused to you by any misuse of your personal information, unless it is a direct and foreseeable consequence of negligence and non-compliance on our part only.
You are responsible for maintaining your login credentials and other allied password recovery mechanisms like phone numbers and e-mail accounts secure.

In the event of non-compliance with this privacy policy or User Agreement or such applicable laws by us, you may terminate usage of our services.

H. Acknowledgement

If you visit any third party Platforms or links that may be available on the Platform, please note that the use and collection of your data will be governed by such third party’s privacy policy and we shall not be liable in any manner whatsoever for use and processing of such data by third parties.

By agreeing to this policy, you also agree to not host, store, transmit, display, upload, modify, update, share or publish, on our Platform or any such platform (e-mail groups etc) which you are a part of, by virtue of accessing or using the Platform any information that :

belongs to another person and to which the user does not have any right;
is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or an online game that causes user harm or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
is harmful to child;
infringes any patent, trademark, copyright or other proprietary rights;
violates any law for the time being in force;
deceives or misleads the addressee about the origin of the message or knowingly and intentionally miscommunicates or information which is patently false and untrue or misleading in nature
or, in respect of any business of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as the Ministry may, by notification published in the Official Gazette, specify;
impersonates another person;
threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
is in the nature of an online game that is not verified as a permissible online game;
is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game;
is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

We respect all the rights accorded to the citizens under the Constitution, including in the articles 14, 19 and 21.
